Stay compliant with new ACI eManifest changes

In 2015, regulatory amendments were announced in Canada that made eManifest requirements for freight forwarders legally binding.

These requirements applied to bonded and non-bonded freight forwarders who are responsible for consolidated (including back to back) imports, and shipments transiting through Canada.

What’s changing?

Since 2015, the CBSA provided an extended voluntary period for eManifest requirements for freight forwarders.

From July 5, 2021, electronic house bills (eHBL) for consolidated cargo may now receive monetary penalties under the Administrative Monetary Penalty System (AMPS), if freight forwarders are not compliant with electronic house bill, close messages and supplementary reports requirements.

What are some examples of the new AMPS penalties?

As of July 5, ACI related AMPS penalties may be issued to freight forwarders when non-compliance is detected, including when:

  • C378: A person failed to submit the prescribed pre-load/pre-arrival information relating to their cargo and/or conveyance.
  • C379: A person failed to submit advance information in the prescribed time or prescribed manner to the Agency.
  • C380: A person failed to comply with a notification issued by the CBSA regarding the goods on board or expected to be on board the conveyance.
